This meeting is compliant with the Governors Executive Order N-08-21 issued on June 11, 2021 allowing for deviation of teleconference rules required by the Brown Act. The purpose of this is to provide the safest environment for staff and the public while allowing for public participation. The meeting will be held by tele or video conferencing and in-person. The public may participate in the Planning Commission Meeting via Zoom Meeting or by attending in-person in the Council Chambers at 80 Fair Oaks Lane, Atherton, CA 94027.

3. APPROVAL OF MINUTES – March 23, 2022 Planning Commission Meeting
4. PUBLIC HEARING
a. Variance – 70 Linden Avenue, Atherton (APN 061-173-070) – Request to locate an accessory structure (swimming pool) with a reduced side yard setback. Atherton Municipal Code Chapters 17.16, 17.32 and 17.40.
Recommendation: Approve the Variance.
b. Variance and Tree Protection Zone (TPZ) Exception – 183 Patricia Drive, Atherton (APN 059-283-020) – Request for a Tree Protection Zone (TPZ) Exception to allow for consideration of reduced TPZ distances for three heritage Redwood trees and a Variance to allow for a detached accessory building (garage) with a reduced front yard setback. Atherton Municipal Code Chapters 8.10, 17.16, 17.32 and 17.40.
Recommendation: Approve the Variance and TPZ Exception.
c. Tree Protection Zone (TPZ) Exception – 1 Nora Way, Atherton (APN 059-313-010) – Request for a Tree Protection Zone (TPZ) Exception to allow for consideration of reduced TPZ distances for two heritage trees, one Deodar Cedar and one Redwood. Atherton Municipal Code Chapter 8.10.
Recommendation: Continue the item to the May 25th, 2022 Planning Commission meeting.
5. STAFF REPORTS
a. Amendments to the Atherton Municipal Code Chapter 17.50 “Landscape Screening” – Discussion of the Town’s Municipal Code regulations relative to landscape screening and possible amendments relative to structures on hillside lots and other areas of study. Atherton Municipal Code Chapter 17.50.
b. 2023-2031 Housing Element Update – Overview of the community meeting held on April 26, 2022 to discuss potential strategies for meeting the Town’s housing goals.
6. COMMISSIONERS’ REPORTS
If you challenge a Town zoning, planning, or any other decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this agenda, or in written correspondence delivered to the City Council at, or prior to, the public hearing. Judicial review of any Town administrative decision may be had only if a petition is filed with the court not later than the 90th day following the date upon which the decision becomes final. Judicial review of environmental determinations may be subject to a shorter time period.
Copies of all staff reports and documents subject to disclosure that relate to each item of business referred to on the agenda are available for public inspection by 5:00 p.m. the Friday before each regularly scheduled Planning Commission meeting at the Atherton Library, 2 Dinklespiel, Station Lane, and the Town Administrative Offices, 80 Fair Oaks Lane, Atherton, CA 94027.
In compliance with SB 343, materials related to an item on this Agenda submitted to the Planning Commission after distribution of the agenda packet are available for public inspection in the Town Administrative Offices, 80 Fair Oaks Lane, during normal business hours.
Planning Commission decisions are appealable by any aggrieved person to the City Council within 10 days of the date of the decision.
