Atherton Police Detectives arrested Pete Alfonso Diaz for being in violation of California Penal Code sections 487 PC- Grand Theft, 470(d)- Forgery, 530.5- Unlawful Use of Personal Identifying Information, and 530.5(e)- Mail Theft.
In summary, this case began back in November of 2018, when an Atherton resident reported that a personal check was removed from her mailbox, altered, and deposited (via a mobile app) under the name “Pete Diaz” for the amount of $600.00.
Bank of America ATM videos helped Investigators determine Diaz’ identity and account information, as Detectives discovered that Diaz had made deposits and withdrawals at two different Bank of America ATM’s in San Jose.
On 02/13/2019, at approximately 2PM, Detectives arrested Diaz (a 50-year-old Gilroy resident) in San Jose at the Santa Clara County Probation Office. Diaz was booked into the San Mateo County Jail.
The Atherton Police Department does not believe that Diaz was involved in the recent spree of residential burglaries.
